I live in WY, and had looked into giving birth in CO in order to take advantage of the favorable laws in CO for pre-birth orders, so yes, it can be done and is relatively easy, since they have been done before. Here are 2 attorney's that I inquired who would have been my representation for the agreement and pre-birth order,(I am a GS) but it got too complicated because neither the IPs or I LIVED in CO, and we would have had to try and establish some type of temp. residency....so we decided that was not a way we wanted to go. But if you live or the IPs live in CO, there should not be any issue. Kim Willouby has worked with surrogacy arrangments already and has done pre-birth orders, so we had preferred her, but both attorneys confirmed that pre-birth orders in CO were attainable.
