Default I am finding very little info on laws in WA state

    Hi,

Both of the parties, IP's us, and our TS, are in the state of WA, I really need to know exactly wha the law says about surrogacy in WA state.

    Compensation?

    PBO?

    etc. etc.
We really want to move forward, but am nervous without knowing all the laws and so far I've only had 1 attorney return a response about surrogacy and that they would be glad to help, but the kicker is they assumed that we were fighting to get custody of our child, when I explained that we were entering into a contract they weren't interested any longer. I have done a lot of legal research and documents, for a company that I worked for and not all of it was easy(corporate tax law). No I am not an attorney just the person they picked to do the job, but I have never had as much trouble get the bare facts as in researching surrogacy. The sites that I can find usually have little to no fact's/laws about WA at all, just a blank space.

    Can you help at all?
    Thanks in Advance,
    Chaynne

Hi, Chaynne. You definitely need to talk to a Washington lawyer who specializes in this field. There is a Washington surrogacy statute and it prohibits surrogacy arrangements that compensates the surrogate. As a result, firms that find and match surrogates stay away from surrogates from Washington state. Read the following opinion by the State Attorney General: http://www.atg.wa.gov/opinion.aspx?s...=topic&id=8870.
Remember that I am not a member of the Washington Bar, so you should check with a Washington attorney. I can give you the contact information for someone who practices in the ART field if you want to e-mail me separately.
    Good luck!
    Diane
