    Default Colorado surrogacy

    Are contracts between a same-sex couple and a gestational surrogate in Colorado enforceable? Can we both get on the pre-birth order? Thanks.

    In Colorado, surrogacy is established by case law not statute. When my firm finds Colorado GC's, we associate local co-counsel because none of us are Colorado attorneys. So far, the IP's we have matched to Colorado GC's have been traditional couples, so we have not asked about same-sex couples in CO. The website I always check first for state laws for our same-sex couples is www.hrc.org, but they are silent about CO. Sorry I cannot help you on this one, Diane

    As a former GS for a same-sex couple I can tell you that Yes, two men can gain a PBO in Colorado get both be on the Birth Certificate. It is done through only one County Court and that is the Boulder County Courthouse.

    Thanks, Kyrstin. That's what I love about these Boards! And I am very happy to hear that it is a possibility at least somewhere in Colorado
