    Default I have a question...

    Hi there...I have a question for you. We are going through an agency for being a GS. They are located in Southern California. I am supposed to be getting a retainer letter from them regarding the GS (that's me.)

    Do I also need to get my own lawyer here where I live? Or do I go with the lawyer that the agency has?

    Hi, Andrea. Congratulations to you as you start your journey. Will you deliver in Oregon? If so, then the law of the state of Oregon will apply and an attorney from Oregon needs to prepare the gestational surrogacy agreement. Either way, you have the right to be represented by your own lawyer, separate from the IPs' attorney. The IP's will pay for that representation, however.

    Hi Diane, and thank you for the info. Yes, I will deliver in Oregon. So, am I correct in saying that the IP's will pay for the Oregon representation? I know that they are already paying for the representation in California, so in essence, they are paying for both representations?

    Hi again, Andrea. So, the IP's will pay for your representation in Oregon pertaining to your gestational surrogacy agreement. I've never heard of IP's paying to review your agreement with your agency, which seems to be what you're asking. Hope that clarifies. Diane
