I am a parent of twins through surrogacy. I would think that problems that arise with surrogacy contracts are the same as those with any contract. Misunderstandings between the two parties, situations that might arise that aren't covered by the contract, and the legality or enforceability of the contract in the state(s) it is written in. Most of the people I know use the contract as a way of laying out what is expected from all parties involved and hope that they have every possible occurrence covered -- even down to what happens in a stillbirth, who names the babies, etc.

I would see the advantage to being a surrogate that you get to give the most precious gift one person can give to another -- giving life to their child. Carrying a pregnancy can be aggravating enough if it is yours -- aching back, being kicked in the ribs, risk of pre-term labor, even risk of death. But, these special angels are willing to go thru all this to help someone who, in most cases, they might never have known except for the surrogacy.
