    17. I am currently in search for an AI surrogate but I was wanting to know how payments are usually made to the surrogate? Do they get it after the birth or in monthly payments? When do payments start? Thank you for any info or personal experience you have. - Aimee in VA - Top

    Dear Aimee,

    You as the IP's have the right to decide how your payments will be dispersed. My first surrogacy I recieved my fee in one lump sum of $9,000. But, the attorney who is handling the escrow will be doing monthly installments and the remainder is lump sum at the end. So there are so many ways to do it. Research what will be more of a convenience and comfort to your situation. I suggest asking and seeing if you can get different AI contracts and look at how those are done. Also, SMO has a listserve, which has IP's and SM's, it is a river of knowledge for the beginner to the surrogacy process.

    Our original contract called for our SM to be paid in monthly installments but our SM wanted us to hold it and pay her a lump sum after the baby was born. About 2 weeks after we got pregnant our SM asked us if we would mind changing it again with us giving her partial payment now and the rest after the baby is born, which we did. So as you can see there is no NORMAL way for SM's to get paid...just whatever works best for those involved. However, I will say that in most cases I have heard about the SM's fee is placed in escrow and she receives it in monthly installments throughout the pregnancy. Hope this helps.

    We are paying our surrogate's fee on a monthly basis. Payments started on the first of the month following confirmation of pregnancy in 9 equal payments with the balance, if any, due at the birth. According to our contract, as long as the pregnancy goes past 32 weeks gestation, our SM receives the entire fee. We are also having twins, which is much less likely in an AI surrogacy, so we are paying a twin "bonus" which started the first of the month following confirmation of the multiple pregnancy.

    I do know a surrogate who wanted her fee be paid at the end of her surrogacy in a lump sum. Either is fine, but if I were doing a lump sum payment, I would want the money in an escrow account so I would know it was there as long as the contract was followed.
